Bank Statements: The New Law & What DWP Haven’t Told You

Bank Statements: The New Law & What Public Authorities like DWP Haven’t Told You

If DWP have asked for your bank statements, or you are worried about what your transactions could show, this video explains what you need to understand before you upload anything.

The Public Authorities (Fraud, Error and Recovery) Act 2025 gives DWP new powers around fraud, error, debt recovery and bank information. One of the most important things people need to understand is the difference between:

— DWP asking you directly for bank statements
— banks being asked to check eligibility indicators
— DWP obtaining bank statements as part of debt recovery enforcement
— deductions being considered from a bank account
— what protections and safeguards still apply

This video breaks down the new law in plain English, including the 3-month bank statement rule, what DWP may be looking for, what “silent” bank checks really mean, and why organising your own financial evidence matters.

In this video, I cover:

✔ Why DWP are requesting statements more often
✔ The new bank statement safeguards in the Act
✔ What the 3-month rule actually means
✔ How bank data may trigger further checks
✔ The difference between eligibility checks and debt recovery powers
✔ Why self-employed claimants need to be especially organised
✔ What to do if you have already been asked for statements
✔ How to explain transactions before they become a problem
