The Upper Tribunal have also ruled against DWP that Claim closures for not providing evidence to check eligibility once a claim is open is not lawful. 

In simple terms, you can refuse to provide bank statements, but that does not mean there will be no consequences. If Universal Credit asks for evidence that it says is needed to check your entitlement, refusing to provide it could affect your claim, payments or review. The safer question is not just “can I refuse?” but “what information is actually relevant, necessary and proportionate?

 

Bank Statments requests, as of October 2025, the FEAR act (FRAUD, error and recovery Act) states that all Public authorities can now use this act to exercise an astonishing amount of requests and recovery, but only if the requests are related to FRAUD.
